Traffic accident handling process

There are many cars traveling during the morning and evening peak hours, so congestion is inevitable, and even traffic accidents such as bumps and scratches may occur. There are different opinions on the process of handling traffic accidents. So, what is the process of handling traffic accidents?

1. Fix on-site evidence:

The methods of fixing on-site evidence can be by drawing scene sketches, taking on-site photos and videos, or by on-site oral questioning.

2. Order the parties involved to evacuate the scene and restore traffic; those who refuse to evacuate the scene will be forced to evacuate.If the party concerned is unable to move the vehicle on his own, the traffic police shall move the vehicle to a location that does not obstruct traffic.

3. If any of the following circumstances occurs, the public security and traffic management department will move the motor vehicle driven by the vehicle to a location that does not hinder traffic or park it at a location designated by the relevant department, and impose penalties in accordance with the law:

(1) The driver does not have a valid motor vehicle driving license;

(2) The driver is suspected of drinking, taking state-controlled psychotropic drugs or narcotic drugs.

4. Prepare a road traffic accident certificate:

(1) After leaving the scene, the traffic police shall determine and record the time, place, weather, name of the parties, motor vehicle driving license number, contact information, motor vehicle number of the road traffic accident based on the evidence fixed at the scene and the narratives of the parties and witnesses. Type and license plate, insurance certificate number, traffic accident form, collision location, etc., and determine the responsibility of the party based on the role of the party's behavior in the occurrence of the road traffic accident and the severity of the fault, and prepare a road traffic accident determination letter, which will be issued by Signature of the parties concerned.

5. Mediation on the spot:

If the parties jointly request mediation (orally, the application can be made), the traffic police shall conduct mediation on the spot and record the mediation results in a road traffic accident determination document, which shall be signed by the parties and delivered to the parties. However, mediation is not applicable if one of the following circumstances occurs; the traffic police may deliver the road traffic accident determination letter to the parties after stating the relevant circumstances in the road traffic accident determination letter:

(1) The parties concerned have objections to the determination of the road traffic accident;

(2) The party concerned refuses to sign the road traffic accident determination form;

(3) The parties do not agree to mediation.
